BAKER Brennans is to ask the Supreme Court to rule in its copycat packaging row with McCambridge's tomorrow.
The cut-throat rivals both sell wholewheat soda bread in flat packs in similar re-sealable packaging.
McCambridge's last month won a High Court injunction against Brennans after accusing the rival of copying its packaging.
The injunction will force Brennans to change its wholewheat soda bread packaging but has been suspended temporarily.
Yesterday, at the High Court, Brennans barrister Declan McGrath confirmed the baker would be appealing in the Supreme Court.
Confirmation of the appeal was made after High Court Judge Michael Peart decided who would bear the costs of McCambridge's four-day case against Brennans.
Brennans lost the case and would normally pay all the costs, which have been estimated at around [euro]500,000.
But Mr Justice Peart ruled McCambridge's had failed to prove Brennans had deliberately copied its packaging.
He also said half-a-day of the four-day trial was lost as McCambridge's was unable to produce witnesses. …
