Lewis v Eliades and others ([2005] EWHC 2966 (QB))' QBD (Nelson J) 20 Dec2005

The court commented that, where an eminent textbook upon a subject set out a proposition and cited authority for it, it was perfectly proper for such an authority to be brought to the attention of the court notwithstanding that it might fal foul, on its face, of Practice Note [2001] 2 Al ER 510 on the citation of authorities. Guidance which the Civil Aviation Authority issued in March 2005, entitled "Sale of Air Package Arrangements: advice on the need to provide consumer protection", was wrong in that it did not have regard to the definition of "package" in para 1 of the Civil Aviation (Air Travel Organiser's Licensing) Regulations 1995, SI1995/ 1054, and in that it omitted any mention of the proper interpretation of "inclusive price" in that paragraph. …
