It is the underlying spirit of the Bipartisan Campaign Reform Act of 2002 that finally is so depressing. It is not enough that the act flouts the 1 st Amendment. That, too, but the whole idea behind the act is a bad idea.
That idea may best be expressed in Orwellian terms: Fettered speech is good; unfettered speech is bad.
Under Section 403 of the act, the Supreme Court is directed to expedite a test case challenging the act's constitutionality. Two such cases already have been filed in U.S. District Court here in Washington and presumably will reach the high court next fall. Meanwhile the BCRA, as it is unpronounceably known, will provide a busy practice for lawyers. …
