Despite dedicating two full pages of the Newspaper of Record to Burlington Industries v. Kimberly B. Ellerth, one of the sexual harassment cases decided by the Supreme Court this term, the New York Times still could not comprehend the facts or the holding of the case.

In its June 27, 1998, editorial, the Times explained that the Supreme Court ruling would not help Paula Jones in her appeal because, "in dismissing her case, Federal Judge Susan Webber Wright found that Mr. Clinton had never made a clear threat, which remains a prerequisite for her claim of harassment." Well, no, actually, the court's holding in Ellerth is completely irrelevant to Jones's suit.
