On Wednesday, February 13, 2013, the White House issued a release stating that the president has re-nominated Richard T. Griffin and Sharon Block as NLRB members. The president appointed Block and Griffin to the Board in 2012 using his recess appointment powers. The constitutionality of those appointments has been challenged, with opponents saying that the president lacked the authority to make the appointments because the Senate was technically in pro forma session.

Secretary of Labor Hilda L. Solis announced on Wednesday, January 9, that she had submitted her resignation to President Barack Obama. Seth D. Harris has been named Acting Secretary. The White House has not yet nominated a permanent secretary.

On December 16, 2012, the term of NLRB Member Brian Hayes expired, leaving the five-member Board with only three members, all Democrats. Chairman Mark Pearce and Members Sharon Block and Richard Griffin remain on the Board.

NLRB Acting General Counsel Lafe Solomon announced that Deputy Assistant General Counsel Elizabeth Kilpatrick has been appointed as Assistant General Counsel in the Division of Operations-Management of the Office of the General Counsel in Washington. …
