Mother of student with "special needs " brought §1983 action against school district, alleging violation of Americans with Disabilities Act (ADA) and Individuals with Disabilities Education Act (IDEA). During his second grade school year, the student was identified as having special needs. The school district, in cooperation with the student's mother, created an Individualized Education Program (IEP) for the student and implemented it the following school year. When the student applied for admission to a magnet high school five years later, his application was declined as he could only write at a third grade level, the student's mother filed an administrative action against the school. An administrative law judge found that the school district had violated the IDEA and ordered compensatory education. The student was unable to obtain a placement in a compensatory program prior to his high school graduation. …
