Rules of Professional Conduct for Occupational Therapists

A. RELATIONSHIPS WITH, AND RESPONSIBILITIES TO, CONSUMERS
Principle1. ConfidentialityBeyond any essential sharing of information with professional colleagues, occupational therapists must safeguard confidential information relating to consumers.Notes
a. The disclosure of confidential information is permissible when :
i. there is legal compulsion;
ii. a consumer gives consent;
iii. as a citizen it is one's duty to act in the public interest.
b. Refer to current NHS Code of Practice on access to personal health information particularly related to Data Protection Act 1984.
c. Refer to Director of Social Services/Social Work for current procedures
i. Contacts made for or on behalf of consumers during the course of treatment will only be made with the consumer's knowledge. Every effort must be made to ensure the consumer is aware of the course of treatment and has given consent to contact being made, particularly with outside agencies.
ii. No information will be given to a consumer (or that person's relatives) about another consumer without the consumer's consent. This principle should also apply to confidences given between colleagues.
iii. Requests from third parties (e.g. solicitors) for information regarding a consumer's diagnosis, treatment, prognosis or future requirements will only be given with (a) the consumer's consent, (b) the consent of the consultant in charge and (c) after clearance from the employing authority's legal advisor. Notes should not be surrendered but an appropriate precis made of the relevant facts. Requests/demands for the notes on a consumer should be directed via the unit general manager or director of Social Services/ Social Work.
iv. All notes shall be kept in a secure place and made available only to those who have a legitimate need to see them. Consumers' requests to see their notes should only be granted when confirmation has been received from all those who have contributed to them that they are happy for this to occur. Access to notes by consumers must conform to the employing authority's procedure.
