Best Practices to Help Minimize Risks and
Maximize Compliance

Do
Establish comprehensive, written rules and policies that address employee use of e-mail, the Internet, and all other electronic business communication tools2014old, new, and emerging. Assign experienced legal counsel a lead role in the company2019s e-policy program. Among other business-critical tasks, have your legal expert:

Create a formal definition of 201Cbusiness record201D for your company
Review all electronic rules and policies to ensure that all applicable
laws and regulations are addressed
Determine record life cycles and retention policies
Establish and enforce litigation hold policies and
Oversee the preservation and production of e-mail records and
other electronically stored information in the event of a workplace
lawsuit or regulatory investigation.

Establish an e-policy team to oversee the development and imple- mentation of the organization2019s e-risk management program. The ideal corporate e-policy team would include a lawyer who is experienced with electronic business communication risks and requirements, along with the organization2019s chief compliance officer, records manager, IT director, human resources manager, and training manager.
