Residents Claim Code Violations at Cimarrone Community Pool; Homeowners Association and Developer Are in Negotiations over Amenities

Mustard and black colored algae continues to grow in what was once the crystal clear pool of Cimarrone Golf and Country Club, turning the water a murky green color fit for wildlife but certainly not residents in the gated community on County Road 210.

Cimarrone Homeowners Association is looking into possible county code violations at the community pool, including inoperable lights, problems with water level control valves and no vacuum gauge on the pump.

Also, the association claims the pool's pump was installed with non-pressure-rated piping and the pump motor for the wading pool needs replacing.

The association said these violations and repairs should have been taken care of by Cordele Properties, Inc. the owner of the facility.

Cordele turned over the ownership of the community on Dec. 31, according Patrick Murphy, a principal partner in the company. Cordele held back ownership of the amenities center and has requested the association submit a 36-month operating plan for the center before the deed and title can change hands.

When asked specifically about the possible violations, Cordele responded only with an e-mail statement saying positive dialogue is under way between the homeowners association and the builder regarding transfer of ownership for the amenities center.

"Any discussion or conclusions at this time would only serve to prematurely undermine the positive strides that have already been made in this process and denigrate the generous gesture of the developer," the e-mail said.

Association members say they want to ensure they eventually take control of a working facility. So, they are taking a conservative approach in order to fully understand what needs to be done to repair the existing facility and how much it will cost to bring it up to code.

"It's already an inflamed situation," association member Jim Whitmire said regarding the amenities center. "We believe that negotiations should proceed very carefully for the good of our homeowners. …
