Dennis Davis Takes Swipe at Unnamed Critic of Court Decisions

CAPE High Court Justice Dennis Davis has taken a swipe at an unnamed competition lawyer who criticised decisions he had made in the Competition Appeal Court, saying it was "unfortunate" the source did not have the courage to be named.
Judge Davis, who is applying for re-election as Judge President of the Competition Appeal Court, made the comment during his interview with the Judicial Service Commission (JSC) yesterday for this position and for appointment to the Labour Appeal Court.
The comment stemmed from a question by JSC member Marumo Moerane about reports of tension between Judge Davis and the chairperson of the Competition Tribunal after the Competition Appeal Court overturned decisions of the tribunal.
Judge Davis said there was always tension between courts and no one liked it when their decisions were overturned.
But he said the court upheld decisions of the tribunal more often than it overturned them.
