Man Indicted after Judge Tosses out Charges Rolling Meadows Man Accused of Shooting Man Who Met Daughter

Rolling Meadows resident Kevin Kincaid was back in Cook County Jail Friday on charges he shot a 25-year-old man trying to see Kincaid's 14-year-old daughter, a case a judge originally threw out of court.

Police arrested the father, Kevin Kincaid, 39, about noon Friday as he was moving out of his apartment at 4726 Arbor Drive. Kincaid had been evicted, police said.

After Cook County Circuit Court Judge Sam Amirante originally tossed the case out last week, prosecutors took the case to a grand jury - which they have the legal right to do.

Kincaid then was indicted on charges of attempted murder and aggravated battery with a firearm, Rolling Meadows Deputy Police Chief Doug Larsson said Friday.

During a hearing last week, Amirante repeatedly questioned why the 25-year-old victim from Mount Prospect and a friend were visiting the young girl at 3 a.m.

The victim's friend told the judge they were going to Denny's.

"Let me get this straight," Amirante said, according to a hearing transcript. "This guy is invited over to this 14-year-old girl's apartment at 3 o'clock in the morning to get her, to take her to Denny's?
