The Waste Management Licensing (Amendment etc.) Regulations 1995
S.I. 1995 No. 288The Secretary of State for the Environment as respects England, the Secretary of State for Wales as respects Wales and the Secretary of State for Scotland as respects Scotland, being Ministers designated1 for the purposes of section 2(2) of the European Communities Act 19722 in relation to measures relating to the prevention, reduction and elimination of pollution caused by waste, in exercise of the powers conferred on them by section 2(2) of that Act, sections 29(10), 33(3), 74(6) and 75(8) of the Environmental Protection Act 19903 (having in particular had regard in exercising their powers under section 33(3) of that Act to the matters specified in section 33(4) of that Act), and of all other powers enabling them in that behalf, hereby make the following Regulations:
Citation, commencement and interpretation
1. (1) These Regulations may be cited as the Waste Management Licensing (Amendment etc.) Regulations 1995 and shall come into force on 1st April 1995.(2) In these Regulations, unless the context otherwise requires--"the 1990 Act" means the Environmental Protection Act 1990;"the 1991 Regulations" means the Environmental Protection (Prescribed Processes and Substances) Regulations 1991;4 and"the Principal Regulations" means the Waste Management Licensing Regulations 1994.5

Technical competence--transitional provisions
4. (1) Where before 10th July 1995 a person has applied to the Waste Management Industry Training and Advisory Board for a certificate of technical competence and at any time in the 23 months ending on that date he acted as the manager of a facility of a type listed in Table 1 in the Principal Regulations6 for which the certificate is a relevant certificate, then, until 10th August 1999, regulation 4 of the Principal Regulations shall not apply to him in relation to either--
a. any facility of that type; or
b. a facility of any other type if--
I. the certificate is a relevant certificate for that other type of facility; and
