The Many Colors of 'Win-Win'

PRESS Secretary Ignacio Bunye's reaction to the Supreme Court ruling criticizing police abuses under Proclamation 1017, the raid on the Daily Tribune, the openly insolent surveillance of media organizations disliked by the Administration, warrantless searches and arrests, was that it was a win-win thing.

His idea of a win was the court's concession that the President could issue the proclamation.

In the loss column, the administration got a beating from the justices on its violation of civil and human rights.


Writing the majority decision, Justice Angelina Sandoval-Gutierrez noted that the principal provision in 1017 was lifted bodily from the Martial Law Proclamation 1081: "... to enforce obedience to all the laws and decrees, orders and regulations promulgated by me personally and upon my direction."

Under Martial Law, Mr. Marcos could use such language. Can a President of a democratic republic, however strong, talk of issuing decrees?
