SC Affirms Decision on Mining Case

The Supreme Court (SC) has affirmed its earlier decision upholding the authority of the government to control all mining operations in the gold-rich Mt. Diwalwal in Compostella Valley province.In the minutes of the proceedings held last March 16, the SC en banc threw out the various motions seeking to reconsider the court’s June 23, 2006 decision declaring that the mining activities in the Diwalwal Gold Rush Area are within the control of the Executive Department.That ruling was reiterated in the November 20, 2009 resolution of the court in which the Executive Department was given the authority “to award mining operations in the disputed area to any qualified entities it may determine.”The SC, in its latest resolution, denied all motions filed by Apex Mining Company Inc. and the Southeast Mindanao Gold Mining Corp. (SEM) there being no new grounds raised that could warrant a reversal of the previous rulings.The High Court held that no further pleadings shall be entertained as it ordered that an entry of judgment be made in due course.In its November 20, 2009 ruling, the SC also ruled that the Mines and Geosciences Bureau (MGB) “may process exploration permits pending before it, taking into consideration the applicable mining laws, rules and regulations relative thereto. …
