Torts

Student soccer athlete sued opposing team 's college, coach, and player alleging negligence. During a soccer match, the student was struck in the head by an opponent, causing serious injuries. The student allegedly sustained his injuries as a direct result of the opposing coach failing to properly train and educate his player. Held: For the opposing college, coach, and player. Coaches may not be held liable for expected injuries that may occur during a competitive contact sport. Furthermore, since a system of rules exists to control the behavior of both coaches and players, imposing liability for negligence may undermine the established system. Trujillo v. Yeager, 642 F. Supp. 2d 86 (D. Conn. 2009).

Spectator brought negligence action against state university after sustaining injuries during a collegiate hockey game. During a hockey game at the university's arena, the spectator was struck in the head by a hockey puck and sustained injuries. The spectator alleged the university's arena lacked sufficient plexiglass around the ice rink. Held: For the university. The spectator failed to show that the primary function of the hockey team was to generate a profit; therefore, the university's hockey program still qualified for governmental immunity under the Governmental Tort Liability Act. Ward v. Mich. St. U., 782 N.W.2d 514 (Mich. App. 2010).
