Kris Bryant, Take a Knee: Applying the First Amendment to Locker Room Prayers and Religion in College Sports, 36 JC. & U. L. 329 (2009). This article examines how the courts should interpret the First Amendment's Establishment Clause and Free Exercise Clause in relation to religion in collegiate athletics. The Supreme Court has not issued a uniform test to determine violations of the Establishment Clause. Faced with uncertainty, lower courts have applied a variety of tests in an ad hoc manner. The author recommends that the Court declare its support for a Coercion/Endorsement Test, which would find any behavior that endorses religious practice to be impermissible.
