Dear Reader:

The NLRB continues to be the center of the labor storm, with reports of ethics violations, resignations, and judicial decisions blocking key rules coming all in the last few months. With both chamber of Congress either unwilling, or unable, or both to pass legislation affecting labor and employment, it appears as though the focus of the L&E world will remain on the Board.

Earlier this year, President Obama made three recess appointments to the Board, bring it to its full complement of five members.Accordingto the Board's Inspector Generatone ofthose appointees/Terence F. Flynn, had violated government ethics rules while serving as chief counsel for Republican member Brian Hayes. Faced with allegations that he passed confidential information to non-Board employees, Flynn resigned in May. …
