Analysis on Countermeasure to Chinese Juvenile Delinquency Induced by Internet

Abstract: Associating juvenile delinquency with internet crime and crime induced by internet and especially probing into problem of juvenile delinquency induced by internet are impending in Chinese real life. Definition of internet crime is different from definition of crime induced by internet. Property-related crimes for affording net play, violations against another's right to life and health because of net addiction, sexual crimes induced by internet and disserving social public order as net play are main representations of juvenile delinquency induced by internet. We should resolve the problems from lay of system and mechanism by defining and upgrading viable criterions and scientific and effective management mechanisms timely. We should enhance education and guidance to make adolescent' ability of discerning right and wrong and resisting harmful effect from internet strengthened. And family, school and society should play their roles as a linkage.

1. Introduction

Problem of juvenile delinquency is always being paid close attention to by society. This species of subjects of crime have sharp-cut characteristics and are terribly anti-social. Amount of netizens in China has come to 4 hundred and 50 million. As modern information technology, application of network is more and more all-pervading and influential, and internet crimes should be attached importance to by the whole society. Associating juvenile delinquency with internet crime and crime induced by internet and especially probing into problem of juvenile delinquency induced by internet are impending in Chinese real life. Here it's trying to research on state and countermeasure of Chinese juvenile delinquency induced by internet.

2. Definition of Correlative Categories

2.1 Definition of Juvenile

"Juvenile" is a word with high frequency, but up until now there is no unified standard in the world about how to define the age-bracket it referring to. There are some age-brackets for reference as following. UNESCO (United Nations Educational, Scientific and Cultural Organization) defines age-bracket of juvenile as 14 to 34; WHO (World Health Organization) defines age-bracket of juvenile as 14 to 44; UNPF (United Nations Population Fund) defines it as 14 to 24. Various countries also have their own definition about age-bracket of juvenile. In USA and the continent in north America is 12 to 25; In Germany is 15 to 25; In Russia is 14 to 30; In Poland is 15 to 25; In Rumania is 15 to 29; In Latin America is 15 to 24; In Japan is 12 to 25; In Singapore is 15 to 30, etc..[1] Inside a country there are still different definitions about age-bracket of juvenile. For example, in China, State Statistical Bureau defines it as 15-34 as census; China Communist Youth League defines it as 14 to 28; All-China Youth Federation defines it as 18 to 40; and in Hong Kong, Macao and Taiwan it's generally defined as 10 to 24.

In view of the difficulty in defining age-bracket of juvenile clearly, exactly and unified in the short term, here surveying from the standpoint of researching on the issue, it considers 12 to 25 as suitable age-bracket of juvenile. There're several reasons as following: (1) From the standpoint of receiving education, the age-bracket is generally from entering junior high school to graduating as bachelor or even master. So it's easy to be accepted. (2) From the standpoint of marital status, basing on nationwide census in China age at first marriage is 22.66 averagely in 1982, 24.02 averagely in 1996, and entering 21 century about 25. It's in reason to define upper limit of age-bracket of juvenile as age at first marriage. (3) From the standpoint of psychology, at the age about 25 mental growth tends to maturity and personality traits become fixed. So it's also in reason to define upper limit of age-bracket of juvenile as 25. (4) From the standpoint of actual situation of juvenile delinquency induced by internet, people in the age-bracket of 12 to 25 should be main object here. …
