Dismissed teacher brought action under New York Education Law §3020-a and New York Civil Procedure Law §7511 asking court to overturn his arbitration award upholding his termination. Dismissed teacher was reassigned to a self-contained special education classroom. After his reassignment, the teacher received his first unsatisfactory annual evaluation. The teacher's request to return to a regular classroom or change schools was denied. He taught in the special education classroom for two more years, each year receiving an unsatisfactory review. An arbitration hearing officer recommended termination for incompetence. The New York trial court denied teachers petition to vacate arbitration award and granted the New York Department of Education's ("DOE") motion to dismiss. …
