Dear Reader

With the swearing in ofWilliam J. Emanuel on September 27, the National Labor Relations Board is fully seated with its complement of five members. Not since August 2015 has the Board been so composed. Other Board members include Chairman Philip A. Miscimarra, Mark Gaston Pearce, Lauren McFerran, and Marvin E. Kaplan. The Democrats on the Board, Members Pearce and McFerran, have terms that expire on August 27, 2018 and December 16, 2019, respectively.

The General Counsel for the Board has also changed hands. On November 17, Downs Rachlin Marin attorney Peter B. Robb was sworn in. Robb will serve a four-year term, replacing Richard F. Griffin, Jr., who served as General Counsel from November 4, 2013 to October 31,2017. There is perhaps no more influential role at the Board than that of General Counsel, and with Robb's appointment, a clear "Trump Board" has taken shape.

Highlighting the import of Board decisions these past several years, on October 2 the Supreme Court heard oral argument on the long-running legal question on whether the NLRA bars employers from imposing arbitration agreements that mandate individual arbitration of employment disputes and prohibit the class or collective resolution of claims. Uncertainty o ver the legality of such class waivers has been percolating since the NLRB first issued its controversial 2012 decision in D.R. Horton. …
