Former female university student brought Title IX action against university alleging school showed deliberate indifference to student's sexual assault. Maher was sexually assaulted in March of 2014. She identified her assailant as Patrick Whetstone, another student at Iowa State University in May 2014 and the university began an investigation immediately. When Maher returned to the university for Fall 2014, she discovered that Whetstone lived in a building near her on campus. She demanded that the school remove Whetstone from his housing. University officials indicated they could not remove Whetstone until the investigation was concluded and a hearing was conducted and offered Maher two different housing options instead, which she refused. The university's investigation concluded in September of 2014 and found that Whetstone had sexually assaulted Maher. Maher withdrew from the university shortly after the conclusion of the investigation. Whetstone was expelled after his hearing in July 2015. In September 2016, Maher filed a Title IX complaint against the university claiming that she was "excluded from participation in and denied the benefits" of an education program as a result of ISU's lack of response to the sexual assault. …
