Vernons to Fight ASA Ruling in the Courts

The pools giant Vernons is taking the Advertising Standards Authority (ASA) to court to overturn a ruling it made against the company.

Vernons also tried and failed to secure an injunction to stop this week's publication of the ASA report which includes details of the case and the ruling.

It is only the third time in the ASA's 30-year history that a client has turned to the courts in protest. The review will size up all available evidence and can force the ASA to retract the ruling. Previous reviews have led to the ASA changing its operating procedures.

The controversy centres on a complaint made against a Vernons press ad earlier this year which promised a 750,000 [pound] jackpot. The ASA agreed with the complainant's allegation that in reality the amount a person would pocket is far less.

It was the second time in 13 months that the Authority had censured Vernons. In August 1991 the pools firm was carpeted for hyping an inflated jackpot and for its use of comparative advertising. …
