Reversals of Fortune: It's Been the Best of Times and the Worst of Times for Gary Cloutier

ON NOVEMBER 6, GARY Cloutier made history when he was declared the first openly gay mayor of Vallejo, Calif., a Bay Area city of 119,000. The 45-year-old city councilman and former civil rights attorney defeated Osby Davis--who would have been the city's first black mayor--by five votes. Less than two weeks later Cloutier was arrested in Southern California for public intoxication after stumbling out of a Palm Springs gay nightclub. Cloutier was sworn in December 4, but two days later the results of a recount proclaimed his opponent the victor-by three votes. On December 11, the same day Osby was sworn in, Cloutier asked the Solano County superior court to prevent the recount results from being certified because of numerous irregularities: The recount was not conducted in public, no one from the registrar's office supervised the process, and worst of all, a ballot that included a vote for Cloutier was found in the trash. The judge denied Cloutier's request, saying his only remaining option is to contest the results in a trial. …
