Union Prepares to Fight LGPS Change in the Courts

The government has decided that the only members of the Local Government Pension Scheme to be exempt from the extension of the retirement age to 65 will be those due to retire before 2016.

The secondary legislation outlining the arrangements was laid the day MPs left Westminster for recess. They will come into force on October 1, a week before MPs return.

Unions and some fund managers and employers with better-funded schemes have been campaigning for lifetime protection from the rule change for existing LGPS members.

However, the Local Government Association argued that this was unaffordable, and the Department for Communities and Local Government negotiated a compromise protection period to 2016 with a tapered phase-out from 2016 to 2020.

A Unison spokeswoman told Public Finance: This falls far short of the full protection given to other public sector schemes and we will continue to press for full protection, including through the courts. …
