Washington UPDATE: NAFEO, Others Urge Supreme Court To Uphold Affirmative Action Principle in New Jersey Case

The National Association for Equal Opportunity in Higher Education (NAFEO) and twenty-five other higher education associations have entered the fray over a New Jersey case that may affect the future of affirmative action in higher education, particularly faculty hiring.

In the case, called Board of Education, Township of Piscataway, N.J. v. Taxman, a U.S. Appeals Court has ruled against all efforts to promote diversity among school district teachers. The issue is now before the U.S. Supreme Court for its October term.

In its brief, the associations are asking the Supreme Court not to use the case as a stepping stone to ban affirmative action in higher education. The American Council on Education (ACE), the major umbrella organization in higher education, is leading this association effort.

"Educators value diversity among both faculty and students, and in primary and secondary as well as higher education," said the brief filed late last month. Despite differences between students and faculty, "a growing body of research findings shows that faculty diversity is valuable not only in itself but also as a key factor in maintaining student diversity. …
