A Fair Labor Standards Act (FLSA) proposed rule originally forecast to be issued in November will likely be ready in the first quarter of 2015, said Tammy McCutchen, an attorney with Littler who was administrator of the U.S. Department of Labor's (DOL's) Wage and Hour Division during the last major overhaul of the regulations in 2004.

Once a proposed rule is issued, employers should start looking at clas- sifications. There aren't likely to be a lot of changes between the proposed and final rules, and employers may not have enough time to make needed adjustments, according to McCutchen.

At this point, no one knows the exact changes that will be made to white-collar exemptions, but employment law experts are making some educated guesses:
