EMPLOYEE-FRIENDLY TEST FOR CONTRACTOR STATUS

The New Jersey Supreme Court has adopted a new test for determining whether someone is an employee or an independent contractor. An individual is an employee unless the employer can show that: 1) the employer does not exercise control over the worker or have the ability to exercise control; 2) the services provided were outside the usual course of business or performed outside of all places of business of the enterprise; and 3) the individual has a profession that will plainly persist despite termination of the challenged relationship. All three criteria must be met to avoid an employee classification.
