This year marks the 10th anniversary of the inception of the American Arbitration Association's Large Complex case (LCC) procedures and panel of neutrals. Why is this important? It's simple really. It represents an ongoing recognition on the part of this Association that special needs require special solutions, particularly in the high stakes world of complex cases where the disputes carry a minimum value of $500,000. What are we doing that's so special? During this LCC anniversary year we at die AAA are reinvigorating and expanding the breadth of the LCC program and fine tuning the particulars of our LCC administration.

First, a brief bit of history to put all of this into context. In February 1993, the AAA formally launched the Large Complex case program, in an effort to provide larger complicated business disputes involving claims of at least $1 million with top tier services. The key components of the program were (1) the selection of pre-qualified arbitrators who would undergo rigorous training; (2) the creation and implementation of new procedures for administration of cases; (3) procedural flexibility for speedier and more efficient resolution of disputes; and (4) administration of the program and cases by trained, senior AAA staff.

Over die 10 years of the program's existence, a broad spectrum of issues in a wide variety of contexts (such as land development, patent ownership and use, licensing, and employment) have been arbitrated. The program has operated successfully. But after 10 years it is appropriate, even essential, diat we give the program a new coat of paint and accentuate all of die positives that made it groundbreaking at its time of origin and 110 less innovative in 2003. …
