Pharmacists Joining Overtime Class Action Suit against Chain

Pharmacists from 23 states have joined a national class action lawsuit filed in Louisiana charging that Eckerd Corp. owes the plaintiffs back pay for overtime hours.

There may eventually be as many as 2,000 R.Ph.s in the suit filed in U.S. District Court, Western District of Louisiana, said Clayton Davis, a partner in the law firm of Lundy & Davis in Lake Charles, La. Current and former Eckerd R.Ph.s have until June 21 to formally opt in to the suit that the judge has conditionally certified as a national class action. The suit is open to RPh.s who worked for Eckerd any time after March 30,1995, and who worked overtime.

A notice of the legal action was sent in February to current and former Eckerd R.Ph.s based on mailing lists provided by the Clearwater, Fla., chain, Davis said. "Eckerd was also directed to post a copy of that notice in each of its pharmacy locations," he said. …
