Eckerd Enters into Plea Agreement in Partial-Fill Rx Case

ECK MD Inc., an affiliate of Eckerd Corp., has entered into a plea agreement with the Department of Justice to resolve a criminal investigation of its practices related to "partial-fill" prescriptions.

Pursuant to the plea agreement, ECK MD will pay the federal government $1.7 million, ending this investigation. The plea agreement is subject to approval by the U.S. District Court for the Middle District of Florida.

Eckerd has been cooperating with the Department of Justice since 1996, and the firm is now in discussions on a related civil case filed by the government in 1998.

Eckerd's general counsel, Robert E. Lewis, issued this statement: "The investigation was related to practices that we discontinued a number of years ago, when we first became aware of the government's concerns. Now we have chosen to put this matter behind us to avoid the associated disruption to our business and substantial legal expenses."

In a written statement, Eckerd said, "In the past, the systems used by the industry lacked the ability to process partial-fill prescriptions correctly. …
