N.Y. Governor Loses Bid to Withhold Documents

A New York State Supreme Court judge ruled Dec. 30 that New York Governor George Pataki's administration could not withhold documents referring to a property development contract for land near the Erie Canal, according to The New York Times.

The Pataki administration justified withholding the documents on the basis of former President Richard Nixon's refusal during the Watergate scandal to turn over to the U.S. Senate tapes of White House conversations that he secretly recorded. The governor's lawyers contended that the information must be able to remain private so that the governor could receive unbiased, honest advice and opinion, according to The Times.

Justice Joseph R. Cannizzaro disagreed. "We are the people's government, made for the people, by the people and answerable to the people," the judge wrote in his decision. …
