Federal officials missed a Sept. 24 deadline set by U.S. Sen. Charles Grassley, R-Iowa, for them to explain the May subpoena of an Associated Press reporter's home telephone records.

The department obtained John Solomon's records 10 days after a May 4 AP story about the wiretap in an organized-crime investigation that led to guilty pleas by the operators of a Florida pizzeria.

According to Editor & Publisher, the officials are not off the hook for missing the deadline. Grassley is "in close contact" with Department of Justice officials and letting them know he expects an answer, said Grassley spokeswoman Jill Kozeny.

Although justice officials want expanded police powers to fight terrorism, Grassley told them their path might be easier if they either can show they followed procedures in the subpoena aimed at Solomon or admit it was a mistake, Kozeny said. …
