THE POLICE are investigating XXX, a controversial new production at the Riverside Studios in Hammersmith, to establish whether it featured live sex on stage during last night's performance. As described in this paper, a man was dragged from the audience and a woman from the cast attempted to perform oral sex with him. That is, at least, how the matter appeared to reporters and spectators and how it was described by the man afterwards. The theatre company, a Catalan troupe, La Fura Dels Baus, defiantly claims that the man was a plant and his penis a prosthetic.

The police - and the Home Office - will say only that an indecent act in a public place is contrary to the law and it remains to be seen whether they bring a prosecution.

Certainly, the Common Law offence of "lewd, obscene or disgusting behaviour' would appear to be relevant here. But the question of whether a specific offence was committed during the performance is not the only matter at issue. …
