School Board Delays 3 Shutdowns; Failing Broward School's Break Leaves Doubt in Duval

Confused about their authority to shut down chronically failing charter schools, the Duval County School Board delayed a decision about three schools' future at an emergency meeting Monday.

The State Board of Education earlier this month ordered that local school boards close charter schools that received two failing grades from the state in four years. That would mean the end of three Duval County charters -- Kreative Kids, Daniel Payne Academy and Horizons Unlimited.

But a Broward County charter school appears to have won a break from the rules, with the state's blessing, which left Duval County School Board members unsure whether they could do the same.

"They've obviously set a precedent on this," Superintendent John Fryer said.

Local charter school proponents cited a Miami Herald article that said North Lauderdale Academy Charter High would not shut down despite two failing grades. The article said the school likely will remain open with approval from Jim Warford, the state chancellor of K-12 education.

Warford did not respond to requests for comment Monday. A Department of Education spokesman could not say whether Warford approved the arrangement but said failing charter schools needed to be held accountable.

"The state board requested districts shut down schools before beginning of next year," spokesman MacKay Jimeson said. "It's very clear the intent of the board."

Still, the Broward situation "opens the door for our superintendent and our school to do the same," said Tom Diamond, pastor of Abyssinia Missionary Baptist Church. …
