Police: No Charges for Driver in Road Death

ATLANTIC BEACH - The man driving a sport utility vehicle that struck and killed a 21-year-old man last month will not face criminal charges.

Matthew A. Gray III, 21, who lived on Seminole Road in Atlantic Beach, was found lying in the 400 block of Ocean Boulevard about 3:50 a.m. April 15. Sgt. R.A. Harville of the Jacksonville Sheriff's Office Traffic Homicide Unit said Thursday that Gray had alcohol in his blood system and was apparently passed out in the middle of the road.

Harville said an anonymous driver first saw Gray in the roadway and called Atlantic Beach police. Between the phone call and the time officers arrived, a GMC Yukon driven by 58-year-old Thomas Arcuri struck Gray as Arcuri was returning home from a trip.

Harville said an autopsy by the Duval County Medical Examiner's Office confirmed Gray had alcohol in his system.

Arcuri pointed responding officers to the scene and waited for several minutes in his Yukon near the accident, not knowing what he had struck in the roadway, a police report said. …
