'Competition Test' Now a Part of Grocery Planning; PROPERTY INSITE

THE build-up to the publication of the recent findings on UK groceries retailing by the Competition Commission suggested that once and for all supermarkets, quite unjustly in my view, would be brought into line.

The pre-publication hype forecast rigorous control over the growth of these very successful businesses which have seen various rafts of legislation created to control their impact on town and city centres through their out-of-town growth.

Last autumn the Competition Commission said that although grocery retailers were in general "delivering a good deal for consumers", action was required to improve competition in local markets.

This has now been confirmed in the Commission's report with a recommendation for the inclusion of a "competition test" in planning decisions on large grocery stores and measures to prevent exclusivity arrangements and restrictive covenants being used by retailers to restrict entry by competitors and a recommendation to establish an independent ombudsman to oversee and enforce the Code. …
