A SALES manager sacked for smoking in his company car has taken his former employer to a tribunal.

Middlesbrough dad-of-two Raymond Stobbs claims he was unfairly dismissed for "gross misconduct" by Richmond firm Turner's Fabrications Ltd.

Mr Stobbs claimed "nobody had explained" the company's no smoking policy after new legislation was introduced in July 2007.

He told the Thornaby tribunal: "Once the legislation came in I took it I couldn't smoke in work's time, only before and after work and at lunchtimes." The tribunal heard from two of Mr Stobb's former work colleagues who said he had smoked in the car with them inside. But he countered: "It was lunchtime." Peter Turner, the firm's co-director, said Mr Stobbs failed to put no smoking signs in his car as required, despite being given them.

He said: "He was putting the company at risk of heavy penalties, including himself being fined." Mr Turner said Mr Stobb's performance at work had also "not been going well" for about six months and "there were complaints from customers". …
