A Hervey Bay 4WD hire operator being sued says it's in bad taste that lawyers are trying to make a point using this year's fatal Fraser Island crash as an example.

Aussie Trax owner Michael Dwyer said it was inappropriate for Trilby Misso lawyer Renee Zackeresen to connect April 18's fatal crash - in which two people died and nine were hurt - to the rollover on September 2, over which his company is being sued.

Ms Zackeresen said her clients, two British men, 24 and 22, and a British woman, 23, were "lucky not to have been killed".

"Tragically, two of their fellow travellers were not so lucky seven months later," she said.

"Our view is that the hire company should not have been renting this vehicle to such inexperienced drivers."

Mr Dwyer said he was angry that Aussie Trax had been connected to the fatal crash as the troop carrier involved had been rented by another company.

He said Aussie Trax did not rent vehicles to groups of 11 people or with roof racks. …
