Trail Ridge Scrap Looks Destined to End in a Court; City Denies Claims of Breach of Contract by Waste Management

The fight over the Trail Ridge landfill is gearing up in federal court, with Jacksonville officially denying breach of contract allegations raised by Waste Management.

Waste Management, which operates the Westside landfill, believes it has the right to operate the 978-acre site. The city maintains the company only has rights to operate the current 148-acre landfill, which has only a handful of years of capacity remaining.

"The city contends that Trail Ridge does not have the right to operate future expansion or other landfills on the entire 978 acres," the city states in its July 14 response to the lawsuit.

The lawsuit also includes other disputes. Waste Management, for instance, claims it's due a $735,000 reimbursement for a gas-collection system expansion, something the city denies. The city says Waste Management owes an unspecified amount of money for property damage to land adjacent to Trail Ridge site.

Most of the documents filed in the suit focus on the fight over who gets the right to operate Trial Ridge once the landfill is expanded. Assistant General Counsel Loree French said the city not only denied Waste Management's allegations in its response but laid out additional reasons they felt the company should not prevail.

Waste Management officials issued a statement indicating they were aware the city has responded. "We're reviewing the city's filings, and the suit will proceed accordingly," said spokesman Kenneth Haldin.

Both sides have expressed a willingness to have the case tried before a jury. …
