A MAN who tortured a 10-month-old puppy to death while filming it on a mobile phone has been sentenced to three years in jail.

The RSPCA has cheered the decision of Mackay District Court judge Michael Shanahan, who yesterday handed the maximum penalty available under Queensland law to Moranbah man Jonathan Blake, 21, over the October, 2008, killing of fox terrier Peanut.

The dog was reportedly hacked to death by Blake and his 24-year-old co-offender, Trent Cunniffe, and the act filmed on a mobile phone camera, the Brisbane Times reported yesterday.

"No other word but torture can be used to describe what occurred," Judge Shanahan reportedly told the court.

"The pain that the dog suffered cannot be mistaken".

He said the act of videoing the torture aggravated Blake's crime, but noted the defendant had shown remorse.

"(But) it doesn't dull the horror of what you have done," the judge said.

Blake, who has spent nearly a year behind bars on remand, will be eligible for parole next month after serving a minimum of 12 months of the three-year sentence. …
