Officer Fired for Fatal Traffic Crash

A Jacksonville police officer has been fired after waiving a hearing scheduled for Friday to fight the sheriff's decision to terminate him for a traffic crash that killed a man last year.

Rutherford decided last month to fire Officer Marcus Kilpatrick after an internal investigation found he violated the law crashing into Matthew Brice Ogden, 86, while driving 98 mph chasing a window tint violator on Merrill Road.

Kilpatrick remained on desk duty with pay until his decision to waive the hearing. He can appeal to the Civil Service Board or an arbitrator.

Kilpatrick, 30, pleaded no contest Jan. 4 to culpable negligence causing Ogden's death. He was sentenced to a year's probation and 100 hours of community service. The internal investigation began after the criminal case was resolved.
