Man's Involvement in Brawl Earns Suspended Sentence; but One Co-Offender Was Jailed and the Other Was Fined

A MAN involved in a drunken brawl in Mount Morgan received a five-month suspended sentence yesterday, despite one of his co-offenders being sent to jail last year for the same attack.

Anthony John Aston pleaded guilty to a charge of assault occasioning bodily harm in Rockhampton Magistrates Court yesterday and his solicitor Stephanie Nicholas brought up the issue of parity telling the court that one co-offender, Daniel Hixon had received two months' imprisonment on March 5 last year and the other, Zachary Ford Andreasssen received a $500 fine for the offence on July 23.

Ms Nicholas suggested that Aston's punishment should fall between the two.

The court heard that on December 17, 2009 the three men had been at the Railway Hotel and were heavily intoxicated when they got into a verbal argument with the victim.

This argument continued outside the pub where the victim approached Aston and he responded by punching the man in the face with a glass in his hand. …
