THE Wide Bay Burnett Conservation Council may face bankruptcy after it was ordered to pay the costs for its failed court case against SunWater.

The not-for-profit green group went all the way to the Federal Court in its two-year legal battle against Burnett Water, which is now part of government-owned SunWater.

The action was launched in 2008, with the conservation council claiming a fish lift installed at Paradise Dam did not provide an adequate pathway for the endangered lungfish.

But in the Federal Court last week, Justice John Logan ruled that all environmental approval conditions were met when the dam was built.

Wide Bay Burnett Conservation Council spokeswoman Emma Kate Currie said the group would not know its fate until the final judgment amount was handed down in late March, but it was making preparations to fold.
