A FORMER Rockhampton City Council labourer with a penchant for the pokies will spend the next three months behind bars after defrauding the Commonwealth of more than $60,000.

Kenneth Raymond Ludwick, 57, fought back tears yesterday as Judge Grant Britton sentenced him to jail.

Ludwick had earlier pleaded guilty to one charge of defrauding the Commonwealth and another of obtaining financial advantage by deception.

Commonwealth prosecutor Dearne Galbraith told the Rockhampton District Court the deception had occurred over a nine-year period, from December 1997 to December 2006, resulting in overpayment of $60,162.

Ms Galbraith said during this time he earned $242,000 as a council labourer, where his average pay was $1026 a fortnight.

She said the fraud was detected after a data match between different Commonwealth departments.

Ludwick has paid back $9362 through withheld payment from his disability pension.

His former wife had previously pleaded guilty to a similar charge relating to an overpayment of $40,000. …
