MICHAEL Kim McLean punched an older man to the ground and kicked him in the head during a boozy, late-night brawl on a Maryborough street.

But the 31-year-old has walked free from court after being convicted of grievous bodily harm for the November 2010 attack.

The mine worker received a two-year suspended jail term due to his clean criminal record and the fact that he too had been badly bashed that night.

It was a tit-for-tat fight on the street in which McLean and a friend took on a 51-year-old man and his 23-year-old twin sons.

McLean punched 51-year-old Andrew Whalley and kicked him in the left eye, fracturing his orbital floor and badly injuring his shoulder.

Whalley's son saw the attack and retaliated by repeatedly punching McLean in the face until he was unconscious.

McLean's own injuries included a cut to the head, a contusion to the brain and a broken nose and as a result, he still suffers severe vertigo. …
