AN INNES Park North couple who did unlawful earthworks on their ocean-front property next to a marine park are facing a $70,000 bill after Bundaberg Regional Council took them to court.

The couple appeared in Maroochydore Magistrates Court this month and were found guilty of contravening a council enforcement notice that required them to remove a retaining wall and earth pad from the foreshore area of their property and replace and restore an area damaged during unlawful work in 2008.

The matter was pursued by the council after it identified a number of breaches of the planning scheme resulting from the unauthorised work which had been carried out in a sensitive location neighbouring a marine park.

Council planning and development spokesman Ross Sommerfeld said the illegal work, which involved the construction of a house pad and the use of foreshore rocks, happened in 2008.

Cr Sommerfeld said the magistrate had found there was no building approval, no house built and the intention to build a house had been abandoned by the defendants. …
