A LEGAL precedent set in Sydney last year may be the key to the community holding on to the controversial Roundhouse land at Ocean Shores, which was due to be auctioned today.

Legal representatives for the Ocean Shores Community Association this week successfully obtained an undertaking from Byron Shire Council not to sell, exchange or otherwise dispose of any part of the Roundhouse land until March 28 without giving at least seven daysnotice.

The council had voted last year to subdivide the 1.388ha parcel of Orana Rd land, with the first four of 11 lots due to go under the hammer today.

Lawyers acting for the community group claim the historic Roundhouse site is still legally classified as community land and as such it was beyond the council's power to sell.

The lawyers claim a legal case involving land in Manly last year provides a precedent for the Roundhouse case. That case, Save Little Manly Beach Foreshore Incorporated v Manly Council (No 2) [2013] NSWLEC 156 (9 October 2013), stopped the sale of land held by Manly Council zoned for the public purpose of "Special Uses - Community". …
