A SANDWICH was the weapon of choice for a disgruntled passenger who assaulted a Mackay taxi driver.

The victim was buttered and battered, although it's unknown whether it was a six-inch or foot-long sub.

Then 24-year-old Sean Ian Nicol was "angry" when the driver wouldn't let him and two friends eat in the taxi.

It was 1.44am and the men wanted to go home after a few hours in the Mackay CBD on November 24 last year.

They had been told several times by the driver that "no eating allowed in (the taxi)", prosecutor Sheena Hayes said.

After purchasing food at Subway, the three got in a taxi from the Victoria St rank.

The driver asked the three to re-wrap their food, but was told to "(expletive) off" and "hurry up and drive".

When the victim refused to drive the three because they continued to eat, one of the men exited the vehicle slamming the front passenger door so hard the camera fell off its mount and was damaged, Ms Hayes said. …
