Bitter Online Dispute; Cafe Owner Makes 'Serious Allegations' against Mayor

A MURWILLUMBAH cafe owner has discovered the perils of venting on Facebook, especially when your target is the mayor of Tweed Shire.

For legal reasons, we can only report that the lengthy post uploaded on Juice Art Cafe's Facebook page late last week detailed a bitter disagreement between cafe owner Andrew Price and the nearby New Leaf Cafe owner Gary Bagnall, also the shire's mayor.

Within three days the post had been liked by more than 250 people and more than 45 comments added, many of them targeting Cr Bagnall.

Shine Lawyers special counsel George Newhouse said there were "quite serious allegations" contained in Juice Art's status update.

"In this case, because the parties appear to be business competitors, other legal remedies might come into play, such as 'injurious falsehood' and 'misleading and deceptive conduct' could also be considered under the Australian Consumer Law," he said.

Mr Price and Cr Bagnall refused to comment on allegations made in the post, which was removed on Tuesday, but they did say they had buried the hatchet. …
