Hung Jury Is Discharged; Decision Not Reached in Molestation Case

AFTER deliberating for more than 10 hours a jury was unable to come to a decision in the trial of a man accused of molesting his partner's 14-year-old daughter.

The man pleaded not guilty in the District Court in Mackay to one count of indecent treatment of a child under 16 under care in the Mackay district.

The girl would often stay at the property where the man resided with his partner and her children.

In a recording of the interview between the girl and police, that was played for the jury, she told a detective the man had touched her under her clothes but not underneath her underwear, when he was attempting to get her out on bed one morning on a weekend in February last year.

She said she told him to "stop" multiple times and tried to get away from him but he kept touching her, the court was told.

The man, who cannot be named for legal reasons, denied the allegations and defence barrister Bronwyn Hartigan suggested the girl had a "very, very big crush" on him. …
